Please note: This is an English translation for your convenience. In case of any discrepancy, the German version shall prevail. These Terms & Conditions are governed by German law.


§ 1 Scope

(1) These Terms & Conditions apply to all contracts concluded between SVEASØN GbR ("Seller") and the customer via the online shop sveason.com.

(2) Differing terms and conditions of the customer are not recognised unless the Seller expressly agrees to them in writing.

(3) A consumer within the meaning of these Terms & Conditions is any natural person who enters into a transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB).


§ 2 Conclusion of contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) By clicking "Buy now" or "Order with obligation to pay", the customer submits a binding offer to purchase the products in the shopping cart.

(3) The Seller will confirm receipt of the order by email immediately. This confirmation does not yet constitute acceptance of the offer. The purchase contract is only concluded upon the dispatch confirmation.


§ 3 Prices and payment

(1) All prices are gross prices and include VAT where applicable.

(2) Shipping costs are added to product prices and are displayed on the Shipping & Delivery page and during checkout.

(3) For deliveries outside the EU, additional customs duties, taxes and fees may apply. These are borne by the recipient and are not included in the purchase price.

(4) Payment is accepted via PayPal or credit/debit card (Shopify Payments).


§ 4 Delivery and shipping

(1) Delivery is made to the address provided by the customer. The Seller is not responsible for delays caused by incorrect or incomplete address details.

(2) Estimated delivery times are indicated on the Shipping & Delivery page and are non-binding.

(3) Shipments are made via DHL. The customer will receive a tracking link by email after dispatch.

(4) Risk of accidental loss or deterioration of the goods passes to the customer upon handover to the customer or an authorised recipient.


§ 5 Retention of title

The delivered goods remain the property of the Seller until full payment of the purchase price has been received.


§ 6 Right of withdrawal

Consumers have a right of withdrawal in accordance with the separate Right of Withdrawal notice, which is provided during the ordering process and by email. The right of withdrawal does not apply to goods made to customer specification or clearly tailored to personal needs.


§ 7 Warranty

(1) Statutory warranty rights apply. The warranty period for new goods is two years from delivery.

(2) In the event of defects, please contact mail@sveason.com, describing the defect and attaching photos where possible.


§ 8 Limitation of liability

(1) The Seller is fully liable for intent and gross negligence, and for culpable injury to life, body or health.

(2) For slight negligence in breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract.

(3) Any further liability is excluded, in particular for loss of profit and indirect damages.


§ 9 Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not voluntarily do so.


§ 10 Applicable law and jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this applies only insofar as it does not restrict mandatory consumer protection provisions of the country of residence.

(2) To the extent permitted by law, the place of jurisdiction for all disputes arising from this contract is the registered seat of the Seller.


§ 11 Severability

Should individual provisions of these Terms & Conditions be or become invalid, the validity of the remaining provisions shall not be affected.
